Breach of Agreement and contract between an employee and an employer could lead to a huge liability to the organization if done blindly without due process of the law.

According to an information shared in this regard, A Hospital by name Reddington switched the service of its employee one Mr. Aderinde from permanent staff status to a contractual based arrangements, on the basis of internal restructuring of the Hospital, without seeking a dialogue or compensation for the employee.

With knowledge of law and rights, the employee sought the service of a counsel and dragged the Hospital to the National industrial Court for beach of contract. The court stated that Mr. Aderinde was subjected to an arrangement that did not comply with labour standard and resulted in an unjust deprivation and accrued right.

In its ruling, Justice A. N Ubaka of the Lagos Judicial Division ordered Reddigton Multi- Specialist Hospital Ltd to pay Mr. Aderinde a total sum of 18,000,000 within 30 days for their unjust switch.

This ruling is a testament to the knowledge of labour laws which Mr. Aderinde utilized in getting justice over the unjust treatment by the Hospital

While this is commendable, Organizations, companies and firms should always seek the knowledge of legal counsels and Human right persona before taking decion against employees, as such decision could have a long lasting impact wether negative or positive on the organization and the legacy it has built for years.
